LIMITED GUARANTEE

In order for our guarantee to apply the following instructions, along with the care and use instructions posted on our Site, must be followed. 

Shipment

Every tree we ship is of the finest quality and to ensure that you receive a healthy item, each order is carefully handled and shipped.  If your product arrives damaged, please refuse shipment and such product will be returned to us.  Once we receive the returned item, we will gladly reship a new tree, if in stock.  Please note that we will not be responsible for any delays or damage in shipment.  Due to state quarantines, we may be unable to ship certain plant material to some states.  These restrictions are issued by individual State Agricultural Departments.  In the event that we are unable to ship a product to your state, we will refund your purchase price.

Tree Life and Morel Production

 If you have properly cared for your plant in accordance with the instructions posted on our Site and included in your shipment, and you experience an excessive loss (40% or more of your product order) in the first year, contact us.  You must include a detailed description of your loss, along with a picture of the plants that you are seeking replacement.  If deemed appropriate, we will ship a replacement tree for your loss.  You will be responsible for standard shipping and handling for any replacements.  Our guarantee does not cover trees planted in fill, scraped ground, or ground unsuitable for the species as outlined in our care instructions posted on our Site.  Any damage or destruction due to natural disasters, weather, livestock, drought, insecticides, fires, over-fertilization, over-watering, under-watering, etc. is not covered by this guarantee.

The success of our trees in producing morels depends heavily on your adherence to the detailed and specific instructions we provide, weather conditions and planting environment.  Accordingly, with respect to the production of morels, all trees sold on this site are provided “as is” and without warranties or guarantees of any kind, either express or implied, including implied warranties of merchantability and fitness for a particular purpose.

In addition, there are certain inherent risks (known and unknown) in planting, caring for, interacting with and/or consuming plant material including, but not limited to, risks associated with allergies to and toxic effect of mushrooms and mushroom related bodies.  These risks cannot be eliminated regardless of the care taken to avoid any injuries.  Accordingly, in addition to those limitations set forth in our Legal Terms and Conditions of Use, we expressly disclaim any liability resulting from your use of the product. 

Limited License

The cultivation of morels using a product or products obtained through this site is the subject of multiple U.S. Patents, including U.S. Patent Nos. 6,951,074 and 6,907,691.  Accordingly, with your purchase of the products on this site, we grant you permission to use our product and practice our patented process to grow morels for your own personal, noncommercial use.  This license is limited to the practice of the patented process using only products obtained through this site, and no license is granted to you without a purchase by you of a product or products on this site.  You may not make, reproduce, distribute, license, transfer, sell, alter or modify the product or  process.  This is a non-transferable, non-exclusive, limited license.
